Article 1: Terms & conditions

 

  1. Our conditions of use are applicable for every offer by us as Webshop to you as Consumer (every natural person who, for non-professional goals, purchases or uses products or services offered by us). 

  2. To place an order you need to be at least 18 years old. In case you are not 18 yet, we ask you let the order be placed by parents or a legal guardian. When it comes to our attention an order is placed by a minor, we can cancel the order. 

  3. By placing an order on this website, you agree to our general terms and conditions, which are available to read on the website. 

  4. When, apart from the general conditions, other special conditions are applicable, the above also applies. When the general conditions are incompatible with the special conditions, the consumer may call on the text that is most advantageous to him. 

 

Article 2: Our collection & your order

 

  1. As all our perfumes are hand-made on a low perfume batch, they might be available for a limited time.

  2. We endeavor to describe our goods and the order process as completely and precisely as possible. However, to err is human and if we have clearly made an error, we are not required to deliver. 

  3. Your order is complete and our agreement is definitive when we confirm your order via email and as soon as we have received confirmation of your payment via the provider of your credit or debit card of choice. We accept payments via Visa, Mastercard, Paypal. When the provider of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or the non-delivery of your order. Orders without a valid payment in the name of a registered cardholder will not be accepted or processed. 

  4. To purchase a product, you add the product to your shopping cart. Then you fill in your contact information, invoice information and the delivery address. Finally, you will see an overview of your order where you can accept our terms and conditions and confirm your payment by clicking 'order'. You will then be transferred to the payment method of your choice and after payment your order will be confirmed and is final. 

 

Article 3: Right of withdrawal

 

The consumer has the right to waive his purchase without fine, within 14 calendar days, starting from the first day after delivery. Below you can find different situations in which a product can be returned. When the shipping costs are to be paid by us, we only reimburse shipping costs compatible to the normal postal rates. The same is applicable to registered mail. These will be accepted but we only reimburse the costs for normal shipping via current postal rates.
 

  1. I do not want to keep the delivered product. Can I send it back?

When you do not want to keep the delivered product you can, in line with Belgian law, return your purchase within 14 calendar days, starting from the first day after this. This can be done as described below: 

  • Send an email via our contact form on this website with the reason why you want to send it back. Mention your BIC-code and IBAN account number so we can reimburse your for your order. 

  • Return the product in its original packaging (the perfume box is seal with a plastic. If you open/break the sealing plastic, we can't pay you back as we have than no certainty that the perfume was not used) and undamaged to the following address: Peter de Cupere, Deurneleitje 10, 2640 Mortsel,  Belgium. The shipping costs are paid by you.

  • When the article has arrived at our address, we will make sure you are reimbursed on the account mentioned on the return document as soon as possible, within 14 working days.

 

  1. The delivered product is not what I ordered. Can I return it?

When you receive a perfume that does not match the item on your order form, you need to alert us via our contact form within 48 hours, starting from the day following the delivery. Do not return the items before you have received confirmation from us. After confirmation, you can return the item and we will reimburse the total amount and shipping costs. This can be achieved as follows: â€‹

  • Answer on the mail that we send to you and mention your BIC-code and IBAN account number so we can reimburse your for your order the amount and the shipping costs. 

  • Return the article undamaged and in its original packaging to Peter de Cupere, Deurneleitje 10, 2640 Mortsel,  Belgium.

  • Once the article has arrived at our facilities, we will reimburse you as soon as possible, within 14 working days. 

  • Do you still wish to receive the article you originally ordered? Please place a new order in our webshop, as this is the easiest and fastest way for us to get the product to you. 

 

  1. I received the correct product but it has been damaged. Do I get a new copy?


When you have received a damaged product, alert us via our contact form within 48 hours. Do not return the items before you have received confirmation from us to do so. After confirmation you can return the product and we will reimburse you for the purchase and the shipping costs. This can be done as follows:

  • Answer on the mail that we send to you and mention your BIC-code and IBAN account number so we can reimburse your for your order the amount and the shipping costs. 

  • Return the article in its original packaging to Peter de Cupere, Deurneleitje 10, 2640 Mortsel,  Belgium.

  • Once the article has arrived at our facilities, we will reimburse you as soon as possible, within 14 working days.

  • Do you still wish to receive the article you originally ordered? Please place a new order in our webshop, as this is the easiest and fastest way for us to get the product to you. 

 

Article 4: Pricing

 

  1. During the period we mention in our collection, our prices will not be changed, with the exception of changes in VAT rates. 

  2. Our final prices include all taxes and VAT on products and services. This ensures you are not confronted with an unexpected amount after check-out. Shipping costs are also announced during check-out, before your order is finalized. Because perfume is a luxury product it can be that the local customs from your country charge extra taxes. We have no influence or can not change anything about this as this is a matter of your local laws concerning luxury products. 

 

Article 5: Payment

 

  1. We can only accept payments via payment methods available to our webshop.

  2. To ensure a safe online payment and the security of your personal information, our transaction details are done by STRIPE and/or Paypal

 

Article 6: Compliance & warranty

 

We guarantee the products are in accordance with your order and fulfill any reasonable expectations you have of them, taking into account the product specifications that are mentioned in our shop. 

In as much as possible and when reasonable, you have the choice of restoration or replacement. Only when the restoration or replacement is excessive or when it cannot be executed within a reasonable period, you have the right to ask for a discount or dissolution of the selling agreement.  

When the deficiency or defect manifests itself within 14 days of the delivery, we assume the defect was present at the time of delivery, unless we can prove otherwise. After 14 days you will have to prove that the deficiency or defect was present at the time of delivery. 

 

Article 7: Delivery & execution

 

We deliver our products via Bpost Shipping and use their pricing.

All goods and services are delivered at the address given by you during your order. When an item is in stock, it will be delivered at the delivery address in 1 to 15 business days in Europe. Abroad Europe it can take a longer time depending of the shipping. When an item is not in stock in our shop, the client will be notified of this.

Article 8: Circumstances beyond our control

 

  1. In case of circumstances beyond our control, we are not required to meet our obligations. In that case we can either postpone our obligations for as long as the circumstances last or annul the agreement completely. 

  2. These circumstances are defined as situations that are beyond our will and control that partly or completely prevent us from completing our obligations and commitments. This includes but is not limited to: strikes, fires, company failures, energy failures, failures in a (telecommunication) network, network connections or the communication systems that are used, the non-availability of our website, non-delivery of delayed delivery by suppliers or other third parties, ... 

 

Article 9: Intellectual property

 

  1. All content included on the websites including website design, text, graphics, images, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on the Peter de Cupere Perfumes websites are the copyright or other intellectual property of Peter de Cupere or of its content and technology providers. 

  2. Personal permission is granted to registrants to electronically copy and to print hard copy portions of Peter de Cupere Perfumes websites for the sole purpose of facilitating the purchase of Peter de Cupere perfumes. Any other use of materials on Peter de Cupere websites, including reproduction for purposes other than those noted above, modification, distribution, or republication for commercial use or otherwise without the prior written permission of Peter de Cupere, is strictly prohibited.

 

Article 10: Customer control & disputes

 

  1. Naturally, our goal is to make sure our customers are 100% satisfied. If you have a complaint about our services, you can contact us at /info@peterdecupere.com/. We will do our utmost to process your complaint within 7 days. 

  2. Belgian law is applicable on all agreements with clients, no matter what their home address is. In case of disputes, only Belgian courts are qualified to handle the dispute. When for certain international law reasons, a different law is applicable, Book VI of the Belgian Economic Law will be the first point of reference to interpret the situation. 

  3. In case of a settlement outside of a court of law, the 'Consumentenombudsdienst' of the Federal Government is qualified to handle each case of customer disputes.
